Judge Stays King County Climate Case

After a request was filed by King County, U.S. District Judge Robert S. Lasnik ordered to stay proceedings in the municipality’s climate case until the outcome of San Francisco and Oakland’s appeal of their own public nuisance climate suit is decided by the 9th Circuit Court of Appeals.

State Attorneys General Support Dismissal of King County Climate Lawsuit

On October 3rd, twelve state attorneys general filed an amicus brief in the U.S. District Court for the Western District of Washington supporting the energy companies. The AGs argued for the case’s dismissal, writing, “Federal courts should not use public nuisance and trespass theories to confound state and federal political branches’ legislative and administrative processes.”

Judge Alsup Dismisses San Francisco and Oakland Lawsuits for Lack of Personal Jurisdiction

Judge Keenan Dismisses NYC Climate Lawsuit

A federal judge in New York City ruled that a lawsuit brought by the City could not proceed because “Congress has expressly delegated to the EPA the determination as to what constitutes a reasonable amount of greenhouse gas emissions.” The second court in two months to reject such a suit, the court expressed particular concern about the far-reaching scope of the City’s claims, which “implicate countless foreign governments and their laws and policies.”

A federal judge in San Francisco dismissed a lawsuit seeking to hold energy companies liable for climate change. Emphasizing that “our industrial revolution and the development of our modern world has literally been fueled by oil and coal,” the court concluded that it is the role of Congress and the Executive Branch—and not the courts—to weigh the costs and benefits of fossil fuels.

Climate-Change Plaintiffs and Energy Companies Present Unprecedented Science “Tutorial” Before Federal Court

Lawyers for Oakland, San Francisco, and Chevron appeared before a California federal court to provide a “tutorial” on the science behind climate change. Both sides agreed that human activities are a significant cause of global climate change. But when given an opportunity to substantiate their allegations that energy companies have been misrepresenting the facts of climate change to the public, Plaintiffs came up empty-handed, with Judge Alsup declaring that their so-called “smoking gun” evidence was nothing of the sort.
